ABS-CBN CORPORATION, a corporation duly organized and existing under Philippine laws, with business address at Sgt. Esguerra Avenue corner Mother Ignacia Street, Quezon City 1103, Philippines, (including its affiliates and subsidiaries, "ABS-CBN"), allows you access to store.abs-cbn.com website (the “Website”)  conditioned on your unqualified agreement to all the Terms and Conditions of Use provided herein, the terms and conditions in https://bini.abs-cbn.com/terms including its Privacy Policy (https://store.abs-cbn.com/policies/privacy-policy), and any rules of conduct as ABS-CBN may hereinafter implement for the Website (the Terms and Conditions of Use, including the Privacy Policies, shall hereinafter be collectively referred to as these “Terms”).  

 

These Terms shall apply to all other websites and all other digital properties of ABS-CBN (including its subsidiaries and its affiliates), that ABS-CBN allows you to access through your registration to the Website. Your use of the Website constitutes your agreement to all such Terms, as well as the policies expressed in our Privacy Policy.  

 

Transmitting and receiving real-time updates to and from the Website requires an online connection between your internet-ready device (the “Device”) and the Internet. The Internet connection shall be your responsibility and at your expense. The expenses of such connection are as prescribed by the agreement between you and your internet service provider, and according to its applicable terms of payment. ABS-CBN does not provide Internet access. You are responsible for all fees associated with your Internet connection. 

 

MODIFICATION OF THE TERMS OF USE 

 

ABS-CBN may amend the Terms at any time in its sole discretion. You understand and agree that your express consent to the amended Terms is a precondition to your access of, or to your activity within, the Website. ABS-CBN shall likewise post the amended Terms in the Website. Your use of the Website after the effective date of any amendments to these Terms likewise constitutes your agreement to comply and be bound by such amendments, including but not limited to the charges associated with the use of the Website, if any. You agree to check the Terms periodically so you will be familiar with their content as amended or modified from time to time.

DESCRIPTION OF SERVICE 

 

ABS-CBN offers the Website as a portal for the purchase of merchandise manufactured and/or distributed by ABS-CBN (the “Products”). 

 

Any use of the Website and purchase of the Products is governed by this Agreement. ABS-CBN may change the Products displayed in the Website at its sole discretion without any need of notice to you. In case of substitution of Products, ABS-CBN shall have the sole discretion to choose the replacement. 
 

ABS-CBN strives to ensure that Product information is accurate but reserves the right to correct any errors or omissions that may be committed. 

 

ELIGIBILITY 

 

To avail of the services and to purchase the Products on the Website, you must be at least eighteen (18) years of age. 

 

ORDERS AND PAYMENT 

 

You are required to provide complete and accurate information when placing an order. We are not responsible and do not assume any responsibility from any loss or damage to you due to any incomplete or inaccurate information provided to us. 

 

Prices are listed in Philippine Peso inclusive of applicable taxes unless otherwise stated. We reserve the right subject to change the price at any time without notice to you; however, the price of the product when the order was placed will be the price charged. 

 

We accept credit card payment (VISA Mastercard, AMEX, JCB), or e-wallet payment (GCash, Maya and QRPh). By using these payments methods, you warrant that you are the owner or authorized user of the credit card or e-wallet, and that you shall be primarily responsible for all purchases made thereunder. 

 
By using any of the accepted payment methods, you acknowledge that you are subject to the terms and conditions, technical and platform limitations, and the privacy policy/notice of the payment method provider, and that you have read, understood and agreed to be bound by its terms and conditions and privacy policies. We are not responsible, and do not assume any responsibility or liability for the actions, omissions, products of the payment method provider and/or its third-party service providers. 

 

PICK-UP OF CONFIRMED ORDERS 

 

You will receive an e-mail notification through the email address provided upon purchase that your order has been confirmed. 

 

All confirmed orders should be picked-up at ELJCC Bldg. G/F, Mother Ignacia Street. Quezon City, Philippines from November 13, 2024 to November 23, 2024. 

 

SHIPPING OF PRE-ORDERS 

 

Orders for Products for pre-order and which will arrive on a later date will be delivered to you within the following dates from availability of the Product ordered: 

  

  1. Within Metro Manila: Delivery typically takes 1-2 business days. 

  1. Outside Metro Manila, excluding Mindanao: Delivery typically takes 1-5 business days, depending on distance and local transportation infrastructure 

  1. Mindanao: Delivery may take up to 10 business days, depending on distance and local transportation infrastructure. 

 

RETURN PROCESS 

 

For Products that have been delivered to you: 

  1. To initiate a return, please email our customer support team at store-support@abs-cbn.com

  1. You will receive a return authorization number via email. 

  1. Please prepare the following documentation: 

Pictures and Video: While opening the package, please take pictures and record a video to document the condition of the Product/s. This documentation is required for a valid return claim. 

  1. Carefully repackage the Product/s in their original packaging, including all manuals, accessories, and other documentation received with the Product/s. 

  1. Ship the Product/s to the return address provided in your return authorization email. You are responsible for covering the shipping costs of the return. 
      

EXCHANGE PROCESS 

 

For Products that you picked up, you will be asked to check the Products for damage/s or defect/s. If there are any damages or defects, confirmed by ABS-CBN after its inspection, the damaged or defective Products will immediately be replaced. 

 

For Products that have been delivered to you: 

  1. To initiate an exchange, please contact our customer support team at store-support@abs-cbn.com with your order details and the reason for the exchange. 

  1. To ensure a smooth exchange process, you must include a clear unboxing video or picture documenting the condition of the Product/s upon receipt before we initiate the exchange process. Please ship the Product/s back to us at the following address: ELJCC Bldg. G/F, Mother Ignacia Street. Quezon City, Philippines. This will help us verify your claim and expedite the resolution of your exchange request. 

  1. Availability and Shipping: 

Once we receive your request, we will check the availability of your desired replacement Product. If the Product is available, we will ship the replacement to you. You may be responsible for any shipping costs associated with the exchange. If the Product is unavailable, you may be entitled to a refund. 

 

REFUNDS 

 

If after ABS-CBN’s inspection, the damaged or defective Products can no longer be satisfactorily replaced, you may request for a refund through our customer support team at store-support@abs-cbn.com. If ABS-CBN deems that you are entitled to a refund, we will process your refund and notify you when the same is available. 

 

USE RESTRICTIONS 

 

There are certain conducts which are strictly prohibited on the Website. Please read the following restrictions carefully. Your failure to comply with the provisions set forth below may result herein (at ABS-CBN's sole discretion) in the termination of your access to the Website and the Content and may also expose you to civil and/or criminal liability. 

 

You shall not, whether by yourself or anyone on your behalf: (i) copy, download, modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Content or the Website, and in any way or publicly display, perform, or distribute them; (ii) make any use of the Content on any other website or networked computer environment for any purpose, or replicate or copy the Content without ABS-CBN's prior written consent; (iii) create a browser or border environment around the Content (no frames or inline linking); (iv) interfere with or violate any third party or other user's right to privacy or other rights, including copyrights and any other intellectual property rights of others, or harvest or collect personally identifiable information about visitors or users of the Website and/or the Content without their express consent, including using any robot, spider, site search or retrieval application, or other manual or automatic device or process to retrieve, index, or data-mine; (v) defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including others' copyrights, and other intellectual property rights; (vi) transmit or otherwise make available in connection with the Website and/or the Content any virus, worm, Trojan Horse, time bomb, web bug, spyware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component; (vii) interfere with or disrupt the operation of the Website and/or the Content, or the servers or networks that host the Website and/or the Content or make the Website and/or Content available, or disobey any requirements, procedures, policies, or regulations of such servers or networks; (viii) sell, license, or exploit for any commercial purposes any use of or access to the Content and/or the Website; (ix) frame or mirror any part of the Website and/or the Content without ABS-CBN's prior express written authorization; (x) create a database by systematically downloading and storing all or any of the Content from the Website; (xi) forward any data generated from the Website and/or the Content without the prior written consent of ABS-CBN; (xii) transfer or assign your accounts' password, even temporarily, to a third party; (xiii) use the Website and/or the Content for any illegal, immoral or unauthorized purpose; (xiv) use the Content, the Website, and/or for non-personal or commercial purposes without ABS-CBN's express prior written consent; or (xv) infringe or violate any of these Terms. 

 

You shall not commit any of the Cybercrime Offenses defined and penalized in the Cybercrime Prevention Act of 2012: Illegal Access, Illegal Interception, Data Interference, System Interference, Misuse of Devices, Cyber-squatting, Computer-related Forgery, Computer-related Fraud, Computer-related Identity Theft, Cybersex, Child Pornography, Unsolicited Commercial Communications, Libel, Aiding or Abetting in the Commission of Cybercrime and Attempt in the Commission of Cybercrime. You understand that a prosecution under the Cybercrime Prevention Act of 2012 shall be without prejudice to any liability for violation of any provision of the Revised Penal Code, as amended, or special laws.

Without derogating ABS-CBN's rights under these Terms or under any applicable law, infringement of the rights in and to the Website shall result in the termination of all your rights under these Terms. In such an event, you must immediately cease any and all uses of the Website.
